Biden’s No Amendment Is Absolute Is Partially Correct


( – Few things razzle Americans’ spirits on both the right and the left more than the topic of gun control. For decades, Democrats and Republicans made the Second Amendment the most regulated of all the Bill of Rights. Their defense of regulating it stems from mass shootings and protecting lives. While admirable, it may be misguided.

On Thursday, April 8, President Joe Biden proposed a slew of new regulations on gun ownership. In his introduction, he stated that no Constitutional Amendment is “absolute.” He cited restrictions on free speech as an example. The president is partially correct. Except for the Third Amendment, every one of the Bill of Rights has some kind of restrictions. However, regarding the Second Amendment, Biden is wrong.

Erosion of Liberties

In 1787, guns were not a complex issue coming off the heels of the Revolutionary War. At the time, America’s Founding Fathers gave the federal government no authority to disarm its citizens when they ratified the US Constitution. However, they didn’t always agree on whether armed citizens could “adequately” deter the federal government from future oppression. Some wondered openly if the Second Amendment didn’t go far enough.

Fast forward to 2021, America is a very different country than it was in 1787. After World War II, the federal government’s growth and power over its citizens exploded. Since the Patriot Act enactment after 9/11 in 2001 and the Obamacare introduction in 2010, the debate accelerated among Conservatives regarding the federal government’s reach into everyday life and the erosion of liberties enumerated in the Bill of Rights. One can add to the list the Democrats’ enactment of gun control legislation and regulations.

The End Result Is More Government

The message from Democrats is rather confusing. What Biden did was expose his contempt for law-abiding citizens who want to protect their lives, livelihoods, and property from the bad guys. Meanwhile, the criminals roam free with guns. Gun restrictions always hurt those who play by the rules, but they never impede the criminals who don’t care about the law — that’s why they are criminals.

While Democrats work to restrict or remove guns, many on the Left also want to get rid of law enforcement and defund the police. That’s proving to be a colossal failure as murders spike in the absence of police. If people can’t protect themselves, and police aren’t there to protect them, it’s the wild, wild west for the bad guys.

In 2008, the US Supreme Court ruled in District of Columbia v. Heller that the history and language of the Second Amendment protected a citizen’s right to own a gun for their personal defense.

In that context, Biden is wrong about the Second Amendment. The Supreme Court already determined that the right to bear arms is ABSOLUTE.

Perhaps Biden needs better researchers and legal scholars on this issue because all he’s really doing is demagoguing.
