DOJ Rejects Biden's Attempt to Call the Shots

( – President Joe Biden has a terrible habit of putting himself in the center of legal issues involving the Department of Justice (DOJ). If memory serves correctly, the Left lost their collective cookies every time former President Donald Trump expressed his opinion about a legal issue. They claimed Trump crossed the line by commenting on pending investigations and sought to influence the DOJ. One by one, legal experts declared Trump’s actions were a full-blown attack on the rule of law and the integrity of the Justice Department.

Where are all these experts now? On Friday, October 15, Biden said the DOJ should prosecute those who refuse to comply with the partisan January 6 House Select Committee. Former Trump advisor Steve Bannon ignored a subpoena to appear before the committee. He alleges he has immunity due to executive privilege extended to the former president. Other people subpoenaed could also disregard them. Later in the day, the DOJ essentially roasted Biden for interfering and declared its independence to investigate and prosecute according to the law, not whims.

Trump Instructed Former Advisers Not to Comply

In September, the House Select Committee subpoenaed former Trump administration personnel, including former White House Chief of Staff Mark Meadows, Pentagon official Kash Patel, and Bannon. In a letter written by the former president’s attorney, Trump instructed the advisers not to comply with the subpoenas. Seven Democrats and two anti-Trump Republicans make up the partisan commission. The House GOP believes the investigation is illegitimate and a partisan attempt to frame Conservatives for the bad actors who broke the law on January 6.

Biden Interjects and Hurts Credibility of DOJ

This is not new behavior for Biden either. In September, he interjected and wrongly declared border agents guilty of allegedly whipping undocumented Haitians attempting to enter the US illegally. The video showed the agents did not whip anyone but instead used the long straps to communicate between the horse and the agent riding it. Initially, Department of Homeland Security Secretary Alejandro Mayorkas said the border agents did nothing wrong. Then, he changed course after the president’s declaration, all but ruining the border agents’ reputations and destroying the investigation’s credibility.

One month later, it’s apparent Biden has learned nothing. Now, he’s damaging what little, if any, credibility the Select Committee has in enforcing a subpoena through the Department of Justice.

DOJ Declares Independence From Biden

On Friday, the DOJ tried to clean up Biden’s mess. The agency announced it would make its own independent decisions based only on the law and the facts. During the 2020 campaign, Biden promised to put up a wall between the politics of the White House and the legal work of the Department of Justice. Seems he’s forgotten another promise.

Attorney General Merrick Garland previously stated his intent to keep the DOJ independent from political matters. The Justice Department refuses to answer questions of how it might act if the Select Committee sends over a criminal contempt referral over refusals of witnesses to cooperate.

If the committee issues one or more contempt charges, the courts likely will become involved, potentially settling the matter of executive privilege of a previous administration.
