Three Convictions, Two Paroles, One Pattern

Harvey Marcelin has now been convicted of murder three times. His criminal history stretches back decades. He was convicted of killing two women in earlier cases, served time, and was released on parole — not once, but twice. Each time the system let him go, another woman ended up dead. The judge at his June 10, 2026, sentencing left no room for debate, telling Marcelin directly that releasing him again would almost certainly lead to another killing.[3]

In 2022, Susan Leyden, 68, was murdered and dismembered. Police caught Marcelin on surveillance video at a store carrying what turned out to be part of her body.[9] He was 83 years old at the time of the killing and had been living on lifetime parole for his prior murders. At trial, Marcelin denied killing Leyden and claimed a “crackhead” had committed the crime while he watched.[8] The jury didn’t buy it. They reached a guilty verdict in about one hour.[2]]

A System That Failed Susan Leyden

The facts of this case point directly at a failure of the parole system. Marcelin was not some unknown offender who slipped through the cracks. He was a convicted killer — twice over — who had been granted freedom anyway. Whatever risk assessments were done before each release, the outcome was the same: a woman died. Susan Leyden paid the price for a system that gave a violent repeat offender the benefit of the doubt.[6]

This is the kind of story that makes people on both the left and the right angry for the same reason. Conservatives point to it as proof that the justice system is too soft on violent criminals. Liberals argue that victims like Leyden — an older woman with no public profile — don’t get the protection they deserve. Both sides are right to be outraged. The system had every reason to keep Marcelin locked up and chose not to.[7]

Judge Closes the Door for Good

Brooklyn Justice Danny Chun sentenced Marcelin to life without parole on June 10, 2026. The judge said there was “no hope for rehabilitation” and made clear that age was not a factor in his decision.[3] At 88, Marcelin is unlikely to live many more years behind bars. But the sentence sends a message: some people have used up every second chance the system can offer. Three murders is three too many.[5]

Marcelin’s case is extreme, but the underlying problem is not. Courts and parole boards across the country struggle with the same tension — how to weigh the risk of releasing a violent offender against the costs of keeping someone locked up. In this case, the system got it wrong twice. The third victim’s name was Susan Leyden. She deserved better. So did the two women who came before her. The life-without-parole sentence won’t bring any of them back, but it does guarantee there won’t be a fourth.[1]
